EU261 vs UK261 for easyJet — Post-Brexit Explained

easyJet Europe (Austrian entity, EU261) operates most continental European routes. easyJet UK (British entity, UK261) operates UK-departing flights. The rights and amounts are equivalent — only the currency and ADR body differ.

How to Claim from easyJet

1

Use the online form

easyjet.com → Manage Bookings → Compensation Claim. You need booking reference (6 chars), flight number (EZY + digits), date and actual arrival time. easyJet has a relatively user-friendly form.

2

Document your delay

Screenshot the easyJet app or use FlightAware. Arrival time = when aircraft doors open at destination. A 2h59 delay doesn't qualify; 3h00 does.

3

Wait for response

easyJet responds in 4–8 weeks. Chase after 6 weeks if no response. For cancellations: ticket refund must happen within 7 days — compensation is separate.

4

Escalate if rejected

For UK flights: CEDR (cedr.com/aviation). For EU flights: your national ADR body (e.g. SÖP in Germany). easyJet participates in both. Escalation success rate is good.

Common easyJet Rejection Reasons — Challenged

Rejection: Technical fault (extraordinary circumstances)

CJEU C-549/07: technical defects are NOT extraordinary. easyJet must prove the specific fault was unforeseeable and beyond all reasonable control — standard maintenance or bird-strike damage to a known vulnerable system rarely qualifies.

Rejection: ATC restriction / slot delay

Only valid if the specific restriction directly caused YOUR flight's delay. Generic 'ATC delays across the network' is not sufficient. Request specific ATFM slot numbers and times.

Rejection: easyJet staff strike

After CJEU C-28/20, strikes by the airline's own employees are NOT extraordinary circumstances. If easyJet pilots or cabin crew struck, you retain full compensation rights.

Rejection: Delay under 3 hours claimed

Check FlightAware independently. easyJet occasionally measures from departure rather than arrival. The clock stops when doors open at your final destination.
