Return Flight from Africa — Does EU261 Apply on the Way Back?

Missed Connections on the Return

Many African return flights connect through Amsterdam, Paris, London or Brussels. On a single ticket operated by an EU/UK carrier, the regulation looks at the actual final-arrival time vs the original schedule. CJEU C-451/20 protects connecting flights through non-EU airports.

Is the return flight from Africa covered by EU261?

Only on EU/UK carriers. KLM, Air France, Lufthansa, BA, Brussels Airlines, TAP — covered worldwide because they're EU/UK-registered. Kenya Airways, Ethiopian, Royal Air Maroc, EgyptAir, SAA — NOT covered when departing African airports because they're non-EU carriers.

Why is the African airport not enough to trigger EU261?

Because African airports are not EU airports. EU261 requires either (a) EU/UK departure airport or (b) EU/UK-registered operating carrier. African airports fail (a); non-EU African carriers fail (b).

Can I claim if my return KLM Nairobi flight is delayed 4 hours?
